General sales terms and conditions

These sales terms and conditions are agreed between Planète Air EURL, a company with a capital of €40,000, Registration Number 482 549 870 RCS Bordeaux - 21, rue Georges Lesieur - 33000 Bordeaux, hereafter referred to as "Planète Air EURL - France Trampoline" or "Planète Air EURL", on the one hand, And any individual or legal entity wishing to make a purchase on Planète Air EURL - France Trampoline's website, france-trampoline.com, on the other hand, hereafter referred to as "the Customer" or "the Buyer".


1 - Subject and Scope

These sales terms and conditions define contractual relationships between Planète Air EURL - France Trampoline and the Buyer, together with conditions applicable to any purchase completed through Planète Air EURL - France Trampoline's retail website, whether the Buyer be a corporation or a private consumer. The purchase of a good or service through this site implies the Customer's unconditional acceptance of these sales terms and conditions.

Planète Air EURL - France Trampoline reserves the right to amend these sales terms and conditions at any time. It is therefore understood that the terms and conditions applicable are those in force on the site at the time of the order by the Buyer on the Site.

The Site user can print these sales terms and conditions.


2 - Features of Products on Offer

Products and services on offer are those listed on the website: france-trampoline.com.

These products and services are offered within the limits of available stock. Stock is updated on a daily basis. Planète Air EURL holds over 5,000 items in stock. However, there may be occasions when the number of items ordered is greater than the number of products held in stock. Should this occur, the Customer will be notified by email or telephone and Planète Air EURL will state the date when the product will become available.

Site or brochure photographs are as accurate as possible however we cannot guarantee that the product offered will be an identical match, particularly regarding colour.


3 - Price

The prices of our products delivered in Mainland France and Europe are listed in Euros inclusive of all taxes, excluding contribution to processing and shipping costs. The prices of our products delivered in French Overseas Departments and Territories and outside Europe are listed in Euros exclusive of all taxes, excluding contribution to processing and shipping costs.

The Customer is liable for the payment of applicable VAT and customs duties to local tax and customs authorities. Planète Air EURL - France Trampoline reserves the right to change its prices at any time, with the understanding that the price listed on the Internet site on the day of the order will the only one that can be applied to the Buyer. Any changes in VAT rate may be applied to the product or service prices. Prices and terms and conditions applicable are those in force on the site on the day of the order.

Unless otherwise stated in quotations, our prices include delivery in Mainland France, in Euros, inclusive of all taxes. An estimate of transport costs may be supplied on request.


4 - Availability

Offers of products and prices are valid while they are displayed on the website france-trampoline.com, and are limited to available stock, excluding special campaigns where the validity period is stated on the Site.

For products which are not stored in Planète Air EURL - France Trampoline's warehouses, offers are valid subject to suppliers' availability. Under those circumstances, product availability information is supplied at the time of the order.

Should a product become unavailable after the date of the order, Planète Air EURL - France Trampoline will notify the Buyer by email, telephone or mail, as soon as information has been received from the suppliers. In addition, there may be occasions when the number of items ordered is greater than the number of products held in stock. In such a case, the Customer will be notified by email, telephone or mail and we will state the product availability date (see page "Order Information", under the "Delivery" tab).


5 - Orders

A Buyer wishing to purchase a product or service is required to:

  • Complete the identification form on which all requested details should be filled in, together with all necessary details for the delivery (including building access codes). The password for accessing customer's account is strictly private. At each visit, when accessing personal data in a session or ordering, the Customer will have been identified beforehand by entering their user name and password, the latter not being used for payment purposes:
  • Order directly on line or print the order form, quoting all the references of the selected products;
  • Confirm the order after verification;
  • Follow conditions provided for the payment.

The confirmation of the order entails agreeing to these sales terms and conditions, acknowledging having full knowledge of them and waiving the right to using their own purchase terms or other terms. All provided information and recorded confirmation will act as proof of the transaction. The confirmation shall serve as signature and acknowledgment of the transaction.

For an order on the website, Planète Air EURL - France Trampoline will send an email confirming the recorded order. Planète Air EURL - France Trampoline shall not be held liable or responsible for consequences of any events outside of their control, in particular force majeure, which would delay or prevent the submission of the order online.

Some orders may lead to extra information being requested from the Customer. In this case, the Customer shall be informed by email or telephone of the supporting documents to send to obtain definite confirmation of their order.

Planète Air EURL - France Trampoline reserves the right to cancel an order if the supporting documents are not received or the documents received are deemed to be non-compliant. The Customer's order may be cancelled by Planète Air EURL - France Trampoline, for whatever reason, in particular if information required for the delivery is not supplied. The customer will be notified of such a cancellation by Planète Air EURL - France Trampoline.


6 - Terms of Payment

Purchases made on Planète Air EURL - France Trampoline's website will be paid at the time of the order by one of the following methods, at the Buyer's discretion:

  • Par carte bancaire des réseaux CB, VISA et MASTERCARD :

    Credit card, CB, VISA or MASTERCARD: payments by card are processed via the Hipay secure system using the SSL (Secure Socket Layer) protocol such that transmitted data is software encrypted and no third party can access it in the course of transit on the network. For purchases in excess of €150 on the Site, paid for by card, Planète Air EURL – France Trampoline uses 3D Secure as a payment security system. The Buyer shall then be required to authenticate himself/herself to confirm the payment.

    Payment in "2 instalments" is available for orders of more than €200 including VAT, and the instalments are divided as shown in the table below :

  • By Paypal

    For purchases in excess of €200, the Buyer can also opt to pay for the order via the secured payment platform PAYPAL. The Buyer will then be redirected on our Partner's site and will be required to enter his/her password if he/she has a Paypal account. If the Buyer does not have a Paypal account, he/she can create one on the said site. Personal and financial data is encrypted automatically when any sensitive information is sent to Paypal servers.

    If a product is returned, the reimbursement will be recredited directly on the Paypal account used to pay for the original order. The account holder's details remain confidential.

Property Retention

The goods will remain the property of Planète Air EURL - France Trampoline until the invoice is fully settled (Law No 80335 of 12th May 1980), plus any accrued interest. For professionals, in the event of late payment, as provided by above terms, late payment penalties will be payable from the invoice due date. The rate applied for calculating these late payment penalties is three times the legal interest rate set annually by decree. A fixed recovery fee of Euros 40 will also be payable from the invoice due date..


7 - Delivery

General Conditions

The Customer commits to supplying, upon placing the order, all the necessary information to ensure successful delivery. In particular, the Customer shall supply a telephone number which the haulier may use to contact the Customer in daytime hours (land line and mobile). The Customer commits, on his/her behalf or on behalf of the order recipient, to take delivery of the goods at the address given at the time of the order.

At the time of delivery, the Customer or the product recipient should be able, upon request, to offer proof of identity. The Customer commits, after opening and checking the package contents in the presence of the haulier, to sign the delivery note provided by the delivery agent. In the event of damages, non-compliant delivery, failure at the time of unpacking or defective products, refer to clause "Return Management". Delivery does not include product installation.

Delivery time

Lead time is up to 10 working days (Mainland France), subject to you or someone you know being available to receive the delivery at the agreed address.
In the event of payment by cheque or bank transfer, the order will be processed only once payment has been received. Consequently, in those cases,lead times will be applied from the date the cheque is received and will therefore be different from those mentioned at the time of the order.
In the event of a foreseen delay in shipment, Planète Air EURL - France Trampoline commits to notifying the Customer as soon as possible and by any means to allow the Customer to confirm or cancel the order in full or in part.

The extension of the delivery deadline can in no way result in compensation for claimed damages by the Customer or their service provider.
In the event of a delay in delivery, an e-mail will be sent to the Customer. In that case, and so long as the product has not been shipped, the Customer may ask to be reimbursed in the form of a credit note, which will be credited to the Customer's account within 48 hrs. This credit note will be valid for 1 year from the date of issue.
Should the Customer opt for reimbursement, a cheque or bank transfer of the amount of the product ordered ill be sent within 14 days following the issue of the credit note.

Post, Packaging and Shipping Fees

For every trampoline order, to be delivered in Continental France, Planète Air EURL - France Trampoline offers free delivery (unless otherwise stated in the quote and the order).
For orders covering accessories only (not delivered with a trampoline), shipping fees are added to the order.
This amount is fixed according to product type and quantity and is stated before final confirmation of the order basket. For any destination other than Continental France, shipping fees are stated before final confirmation of the order.

Deliveries in French Overseas Departments and Territories and Outside of the EU

Orders to be delivered in a French Overseas Department or Territory or outside of the EU are invoiced exclusive of VAT.
At the time of the delivery, tax and customs authorities will require:

  • Applicable VAT amount,
  • Dock dues or customs duties (at local authorities' discretion),
  • Customs inspection fees.

These costs will be payable by the Customer.

Possible Delivery Methods

  • DPD Service or CHRONOPOST: Orders weighing up to 30 Kgs and not exceeding certain dimensions are sent by DPD or CHRONOPOST. No appointment is made for the delivery. Product deliveries require a signature or in the event of the Customer being unavailable, a non-delivery notice will be issued. Under no circumstances may the package be left if the Customer is unavailable on the day of the delivery to receive it. This method of transport is not covered by any insurance.
  • Kuehne + Nagel or Dacsher : The delivery of large packages (over 30 Kgs) - trampolines in particular - is handled by our service provider Kuehne and Nagel for mainland France and DACHSER for other European countries. For mainland France, the haulier will call the customer a few days before to set a day for delivery. For all deliveries, the Buyer should have checked entrance dimensions in advance (door, lift, staircase...).
    Deliveries are made at the recipient's doorstep if it is accessible by the delivery vehicle. The driver is not under any circumstances bound to deliver the goods to a recipient living on an upper floor. At the time when the appointment is made for these large packages, the company responsible for delivery can also offer a delivery made by multiple agents, however the Customer will incur extra charges, payable to the company making the delivery.
    Should the Customer refuse this option and decide to help the delivery agent, the delivery agent shall not carry the goods to the upper floor and shall leave them on the ground floor. The same applies to roads with difficult access, where delivery may be delayed should the delivery address not be accessible by the delivery vehicle. The extra cost of using a special vehicle for the delivery will be borne by the Buyer.
    If the Buyer prefers not to pay extra cost, the Buyer can suggest a second address (friends, neighbours, ...) for the delivery.

8 - Managing Returns

Package Undelivered by Haulier

In the event of non-receipt of a package, an investigation will be conducted with the haulier. During this period, no reimbursement or second shipment may be made.

Following the receipt of the confirmation of the package loss from our haulier, depending on product type, availability and Customer's requirements, we offer the re-consignment of the product originally ordered or an alternative product with similar specifications. If non-delivery of a package is as a result of the Customer (missed delivery appointment, non-collection of package after delivery note, etc.), shipping fees may be charged to the Customer, as necessary.

In the event that the Customer decides against the re-consignment of the product originally ordered or an alternative product with similar specifications, a credit note will be credited to the Customer's account within 48 hrs after the package is received by Planète Air EURL - France Trampoline. This credit note will be valid for 1 year from the date of issue. Should the Customer opt for reimbursement, a cheque or bank transfer of the amount of the product ordered will be sent within 14 days following the approval of the return.

Transport Damage

This clause concerns damaged packages, packages ripped open, missing or damaged products. The Customer shall write his/her claims on the acknowledgment of receipt, sign it, ask the delivery agent for his signature and keep a copy of the document. If the product is damaged, the Customer must refuse to accept the package and write his/her damage claim on the delivery note (package refused as it was open or damaged at the time of delivery, describing the damage in detail). The claims must be precise. The expression "received pending inspection" is not a claim and has NO LEGAL VALUE. It is imperative to describe in detail the exact condition of the packaging and/or the product and the damage (e.g. sound of broken material, open package, damaged or ripped open packaging, dent in the lower right-hand corner, scratched, dented product, on the right-hand side, refused package as it was open or damaged at the time of delivery, etc.). The Customer must also confirm the claim with the haulier by registered post at the latest within 48 working hours after delivery of the product or products and send a copy of the letter to: Planète Air EURL - France Trampoline - SAV . 21, rue Georges Lesieur 33000 BORDEAUX, quoting the references from the delivery note.

Please note: Product condition inspection is deemed to be carried out once the delivery note has been signed. Therefore, IF THE AFOREMENTIONED INSTRUCTIONS ARE NOT COMPLIED WITH, NO CLAIM WILL BE ACCEPTED (Article L.133-3 of the French Code of Commerce). By signing the delivery note without any precise claims and accepting the products, the Customer acknowledges receipt of the goods in a condition meeting with his/her satisfaction. Any claim thereafter in relation to the condition of delivered products will not be accepted. After receiving and accepting the package, depending on the nature of the product, available stocks and Customer's requirements, we will offer to resend the product originally ordered or an alternative product with similar specifications.

In the event that the Customer decides against the re-consignment of the product originally ordered or an alternative product with similar specifications, a credit note will be credited to the Customer's account within 48 hrs after the package is received by Planète Air EURL - France Trampoline. This credit note will be valid for 1 year from the date of issue. Should the Customer opt for reimbursement, a cheque or bank transfer of the amount of the product ordered will be sent within 15 days following the approval of the return.

Delivery Non-Compliant with Order Quality or Quantity

The Customer shall send a letter or an e-mail giving details of the conditions of the goods received. The Customer may also contact us by telephone on 00 33 (0)5 56 36 04 62 (cost of a local call depending on operators).

Failure at the Time of Unpacking, Defective Product

The Customer shall send a letter or an e-mail giving details of the conditions of the goods received. The Customer may also contact us by telephone on 00 33 (0)5 56 36 04 62 (cost of a local call depending on operators).

WARNING: Only products with a proven problem will be accepted. Any request for service which is not sent via the above procedure will not be processed. A confirmation of acceptance will be sent to the Customer with 48 to 72 hours. Once acceptance has been given and if the return is deemed necessary, the Customer will be notified of the return address to send the defective product to, together with the mode of transport to be used, as necessary. Shipping costs for any product return will be reimbursed with a credit note valid for 1 year from the date of issue. The cost of re-shipment will also be paid by Planète Air EURL - France Trampoline.

Returns in Mainland France shall be made exclusively after agreement from the After-Sales Service Department in the form of an approved return form.
Returns from overseas shall be reimbursed with a credit note valid for 1 year. Any goods return not compliant with this procedure will not be reimbursed.

In any event, Planète Air EURL - France Trampoline shall only bear a cost of reimbursement not exceeding 40 Euros (for packages weighing over 30 Kgs).
Products shall be returned in their ORIGINAL PACKAGING, in perfect condition, together with any accessories and instructions.
Should goods be returned incomplete, spoiled, damaged, used or soiled, they shall not be accepted and shall be sent back at the Customer's expense.


9 - Cancellation

Conditions

In compliance with relevant legal provisions, non-corporate private Buyers have the right to return a product to the Seller up to 14 clear days from the date of delivery for a replacement or reimbursement without penalty.
In compliance with Article L.121-20-2 of the French Consumer Code, this cancellation period does not apply to customised products, made-to-measure to Customer's specifications.
The Customer shall bear the cost of cancellation as described hereafter.

Methods

The Customer shall log onto the website france-trampoline.com, click on "My Account", go to the "Payment" tab and click on "Cancellation Form". The Customer shall then type his/her e-mail address (as used in Customer's account) and follow the instructions to fill in the return form. To submit the request, click on "Send" and Planète Air EURL - France Trampoline will then receive the request. The Customer will receive a confirmation e-mail automatically and will be contacted promptly by telephone or e-mail.

The Customer may also notify cancellation of this contract by sending a clear written statement to the following address:

This statement should explain clearly the Customer's decision to use their right to cancel.

Products shall be returned in their ORIGINAL PACKAGING, in perfect condition, together with any accessories and instructions. Planète air EURL – France trampoline offers returns via its haulier ; please refer to pricing information at the "Order Info" page, "Payment" tab.
However, the Customer is free to choose another product return method after agreement from Planète Air EURL - France Trampoline and to subscribe or not to an insurance against loss, theft or destruction of the package. Planète Air EURL - France Trampoline shall bear none of these costs nor the cost of transport and shall not be held liable if the Customer's package is not received. Generally, all product return costs and risk are borne by the Customer.
In any event, the Customer shall pay compulsory costs of €9.60 inclusive of tax for order return processing at the logistics centre. In addition, after sending a return package, the Customer MUST send a copy of the return document. If not, Planète Air EURL - France Trampoline will not be in position to inform relevant third parties and therefore process the return properly.

In the event where the product is not returned as new (i.e. open package, unpacked components, assembled components, item(s) returned unclean), the Customer will be charged DEPRECIATION costs.
These DEPRECIATION costs are a maximum of 50% of the order value. Therefore a minimum of 50% of the order shall be reimbursed within 14 days of receipt of the cancellation request. Returned products shall be reviewed with 2 weeks of receiving the return in order to work out the actual amount of the depreciation costs.

After reviewing returned products, if the items are deemed to be fit for resale second-hand, the difference between the product sold as new and the product sold as a second-hand item shall be borne by the Customer and the product's second-hand value shall be reimbursed.

Articles unfit for resale as second-hand items: Items found to be incomplete, spoiled, damaged, used or soiled on their return shall not be accepted and shall not be reimbursed. They shall be returned at the Customer's expense.

Cancellation Consequences

Ordered product reimbursement shall be made after a maximum of 14 days from the date of cancellation, if the Customer has complied with the above described return procedure. The reimbursement shall be by the method used for payment of the initial order:

  • For payment by card, the reimbursement shall be made directly on the Customer's account linked to the card;
  • For payment par PAY PAL account, the reimbursement shall be made directly on the Customer's PAY PAL account.

The first order shipping costs shall be reimbursed only up to the minimum shipping costs (non-urgent standard shipment). The extra cost of initial express delivery shall not be reimbursed.
If an order of accessories or spare parts is returned in part, returned product outgoing shipping costs shall be reimbursed pro rata of the order total amount and up to minimum shipping costs (non-urgent standard shipment).


10 - Warranty

Planète Air EURL - France Trampoline provides all their Customers with a contractual warranty for each product range and its duration is stated in the product introduction pages, product sheets, as well as Trampoline, Accessories, and Spare Parts pricing documents. This warranty provided by Planète Air EURL - France Trampoline does not cover:

  • Replacement of parts due to wear and tear,
  • Steel part corrosion,
  • Frame pad waterproofing,
  • Fabric or net tears,
  • Cracks, breaks or bending of steel parts in the event of shock,
  • Problems with stitching if pulled,
  • Improper or non-compliant use of products. In this respect, we request that you carefully read the instruction notice supplied with the products,
  • Damages resulting from work carried out by a repair engineer who has not been approved by Planète Air EURL,
  • Damages resulting from a cause external to the equipment (eg. accident, impact, lightning, heavy winds, etc.).

Planète Air EURL - France Trampoline's warranty is applied by replacing the damaged product (excluding delivery costs to and from warehouse).
In the event where the product cannot be replaced, Planète Air EURL - France Trampoline shall repair or replace it with a product with similar characteristics.
This contractual warranty does not exclude the provisions of the legal warranty against hidden defects which is valid for 6 months from the date of delivery.


11 - Purchases by Non-EU Residents

For any purchase from France Trampoline where delivery is outside the European Union or in the French Overseas Departments and Territories, the invoice is exclusive of taxes. In such an event, the Customer will be deemed to be the "importer" of the goods. As such, if import taxes or customs duties (they can vary according to location) apply, the Customer (importer) shall bear these costs.
If France Trampoline is not in a position to inform you of the extra costs to pay on delivery, we recommend that you ask the relevant authorities in your country.

Regarding product returns from non-EU countries and French Overseas Departments and Territories, the cost shall be borne by the Customer.
It is also important to note that the warranty remains valid, however the cost of any shipment outside the EU or to the French Overseas Deparments and Territories will be borne by the Customer (transport + customs duties + local taxes).


12 - Liability

Planète Air EURL - France Trampoline, within the scope of online sales, is only liable to an obligation of due care and cannot be held liable for any damages resulting from the use of the Internet, such as data loss, intrusion, virus, service interruption or other involuntary problems.
Planète Air EURL - France Trampoline shall not be held liable for failure to execute the agreed contract due to the occurrence of an event of force majeure, specifically in the event of an total or partial strike by postal services, hauliers and disasters caused by floods or fires.

Regarding products bought to meet professional requirements, Planète Air EURL - France Trampoline shall not be liable for any indirect damages due to these general conditions, loss of service, loss of profit, damages or costs that could be incurred. The Customer has sole responsibility for the selection and purchase of a product. Should it be impossible to use the products fully or in part, particularly due to equipment incompatibility, there shall be no compensation, reimbursement or invoking Planète Air EURL - France Trampoline's liability, except in the event of proven hidden defects, non-conformity, malfunction or exercise of the right to cancel.

Caution: in compliance with the standard NF EN 71-14 – 2018, leisure trampolines must be sold with a safety enclosure. Standalone trampolines may only be sold as replacement parts, in the event that a trampoline needs replacing when its safety enclosure is still in good condition. Under no circumstances may a trampoline be used without a safety enclosure.


13 - Intellectual Property

Planète Air, France Trampoline and the France Trampoline logo are registered trademarks.

All components of Planète Air EURL - France Trampoline's site are and remain Planète Air EURL's exclusive intellectual property.
Any copying, operation, redistribution or use for whatever purpose, in full or partial, of the site components whether it be software, visual or sound bites, is strictly forbidden. The components are subject to copyright laws.
Any copying, republication ou redistribution by any means whatsoever is strictly forbidden by law without Planète Air EURL - France Trampoline's written authorisation.


14 - Privacy Policy

In compliance with the French Information Technology, Records and Personal Freedom Law, dated 6th January 1978, Buyers' personally identifiable information may be processed automatically.
Customer provided information are for the exclusive use of Planète Air EURL - France Trampoline.
Planète Air EURL - France Trampoline commits to not passing on personal data provided by site users to third parties. The data is confidential.
In addition, users have the right to access and correct data relating to them, in compliance with the 6th January 1978 Law.

As provided for by Law No 78-17 of 6th January 1978 as modified, relating to Information Technology, Records and Personal Freedom, France Trampoline's site is subject to a declaration with the National Commission for Data Protection and Liberties (CNIL). Planète Air EURL's client database is registered with the CNIL under number 1410284.


15 - Storage

Planète Air EURL - France Trampoline shall store order forms and invoices on a reliable and sustainable platform that will be a true copy in compliance with provisions of Article 1248 of the French Civil Code. Planète Air EURL - France Trampoline's computer records shall be viewed by all Parties as a proof of communications, orders, payments and transactions occurring between the Parties.


16 - Jurisdiction

These online sales conditions are subject to French law.

In the event of a dispute, the competent courts will be the Bordeaux Courts (33 - Gironde, France).
For a professional-to-professional sales contract, the Parties expressly agree that the Vienna Convention cannot be applied to international sales of goods within their relationship. As such, any dispute which has not be resolved amicably will be subject to the exclusive jurisdiction of Bordeaux courts, notwithstanding multiple defendants and/or exposure under warranty, including emergency or preventive action, in summary proceedings or petition.
